Simplr Inc. ("we," "us," or "our") operates SimplrAds (https://simplrads.com), a platform that enables brands to deploy creator video content as paid media ads across multiple advertising platforms. This Privacy Policy explains how we collect, use, disclose, and protect your information when you use our services.

By using SimplrAds, you agree to the collection and use of information in accordance with this policy. If you do not agree, please do not use our services.

1. Who We Are

SimplrAds is a SaaS platform that connects brands with content creators. Brands use our platform to manage creator relationships, deploy video content as advertisements on platforms such as Meta (Facebook and Instagram), and track ad performance. Creators use our platform to upload videos, track their earnings, and receive commission payments.

2. Information We Collect

2.1 Information You Provide Directly

  • Account Information: Name, email address, and password when you create an account.
  • Business Information: Company name, billing address, and tax information (for brands).
  • Payment Information: Bank account or payment details processed through Stripe for creator payouts. We do not store full payment details ourselves.
  • Content: Videos you upload to our platform for review and deployment as advertisements.
  • Communications: Messages, support requests, and feedback you send us.

2.2 Information Collected Automatically

  • Usage Data: Pages visited, features used, clicks, and time spent on the platform.
  • Device Information: IP address, browser type, operating system, and device identifiers.
  • Log Data: Server logs including access times, errors, and API requests.
  • Cookies: Session cookies for authentication and preference cookies for user experience. See Section 8 for details.

2.3 Information from Third Parties

  • OAuth Sign-In (Google): When you sign in with Google, we receive your name, email address, and profile picture from Google.
  • Meta Advertising Platform: When you connect your Meta Ads account, we receive ad account IDs, campaign performance data, spend data, and audience insights to power our analytics and reporting features.
  • Stripe: We receive payment confirmation and payout status information from Stripe to process creator commissions.

3. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and improve the SimplrAds platform
  • Create and manage your account
  • Process creator commission payments through Stripe
  • Deploy video content as advertisements on connected ad platforms
  • Track and report on ad performance metrics (ROAS, revenue, spend, conversions)
  • Send transactional emails (account creation, video approvals, payout notifications)
  • Provide customer support
  • Detect and prevent fraud, abuse, and security incidents
  • Comply with legal obligations
  • Analyze platform usage to improve our services

We do not sell your personal data to third parties. We do not use your data for targeted advertising outside of the services you explicitly connect to our platform.

4. How We Share Your Information

4.1 Service Providers

We share information with trusted service providers who help us operate our platform:

  • Neon (Database): Stores your account data and platform records
  • Amazon Web Services (S3): Stores uploaded video files
  • Stripe: Processes creator commission payments
  • Vercel: Hosts our application infrastructure
  • Upstash (Redis): Caches session and performance data

All service providers are contractually required to protect your data and use it only as instructed by us.

4.2 Connected Ad Platforms

When you connect an advertising platform to SimplrAds (e.g., Meta Ads), we share relevant data with that platform to operate our services, including:

  • Video content you have approved for deployment
  • Campaign configuration settings you specify
  • Your ad account credentials (stored securely, never shared with other users)

4.3 Between Brands and Creators

Brands can see:

  • Creator names and profile information
  • Videos submitted by creators
  • Performance metrics for videos they have approved

Creators can see:

  • Their own video performance metrics
  • Their own commission earnings and payout history
  • Basic brand information for brands they work with

4.4 Legal Requirements

We may disclose your information if required by law, regulation, legal process, or government request, or to protect the rights, property, or safety of SimplrAds, our users, or the public.

4.5 Business Transfers

In the event of a merger, acquisition, or sale of assets, your information may be transferred. We will notify you via email and/or a prominent notice on our platform before your information becomes subject to a different privacy policy.

5. Data Retention

We retain your information for as long as your account is active or as needed to provide services. Specifically:

  • Account data: Retained while your account is active, deleted within 30 days of account deletion request
  • Video files: Retained while your account is active; deleted within 60 days of account deletion
  • Performance data: Retained for 24 months for analytics purposes
  • Payment records: Retained for 7 years as required by law
  • Log data: Retained for 90 days

6. Your Rights and Choices

Depending on your location, you may have the following rights regarding your personal data:

  • Access: Request a copy of the personal data we hold about you
  • Correction: Request correction of inaccurate or incomplete data
  • Deletion: Request deletion of your personal data ("right to be forgotten")
  • Portability: Request your data in a machine-readable format
  • Objection: Object to certain types of processing
  • Restriction: Request restriction of processing in certain circumstances
  • Withdraw Consent: Withdraw consent where processing is based on consent

To exercise any of these rights, email us at privacy@simplrads.com. We will respond within 30 days.

You can also delete your account at any time from your account settings page, which will initiate the data deletion process described in Section 5.

7. Data Security

We implement industry-standard security measures to protect your data:

  • All data transmitted between your browser and our servers is encrypted using TLS/SSL
  • Passwords are hashed using bcrypt before storage — we never store plain-text passwords
  • Access tokens and sensitive credentials are encrypted at rest
  • Database access is restricted to authorized personnel only
  • We use JWT tokens for session management with appropriate expiration
  • Regular security reviews of our infrastructure and code

Despite these measures, no method of transmission or storage is 100% secure. In the event of a data breach that affects your personal data, we will notify you within 72 hours as required by applicable law.

8. Cookies

We use cookies and similar tracking technologies to operate our platform:

  • Essential Cookies: Required for authentication and session management. Cannot be disabled without breaking the platform.
  • Preference Cookies: Remember your settings and preferences (e.g., selected dashboard tab).
  • Analytics Cookies: Help us understand how users interact with our platform (aggregated, anonymized data).

You can control cookies through your browser settings. Note that disabling essential cookies will prevent you from signing in to SimplrAds.

9. Children's Privacy

SimplrAds is not directed to children under the age of 13 (or 16 in the European Union). We do not knowingly collect personal data from children. If you believe we have inadvertently collected information from a child, please contact us immediately at privacy@simplrads.com and we will delete it promptly.

10. International Data Transfers

SimplrAds is operated from the United States. If you are located outside the United States, your information will be transferred to and processed in the United States. By using our services, you consent to this transfer.

For users in the European Economic Area (EEA) or United Kingdom, we rely on Standard Contractual Clauses (SCCs) as the legal mechanism for international data transfers where required.

11. California Privacy Rights (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act:

  • Right to know what personal information we collect, use, disclose, and sell
  • Right to delete personal information (with certain exceptions)
  • Right to opt-out of the sale of personal information (we do not sell personal information)
  • Right to non-discrimination for exercising your privacy rights

12. Third-Party Links

Our platform may contain links to third-party websites and services (such as Meta, Google, Stripe). This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party services you use through our platform.

13. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes by email and by updating the "Last Updated" date at the top of this page. Your continued use of SimplrAds after changes become effective constitutes your acceptance of the revised policy.
